Terms of Service

The terms on which Pemberton Tech provides technology support: how work is agreed and quoted, how appointments are secured, how payment is handled, what our guarantee covers, and the limits that apply.

These Terms of Service govern technology support work carried out by Pemberton Tech. By requesting or accepting our services, you agree to them.

They operate alongside our Privacy Policy, which covers information collected through this website.

Who we are and how to reach us

Pemberton Tech provides technology support to residential and small business customers in Pemberton Township, New Jersey and the surrounding communities.

Inquiries are received through the request form on this website, by email at [email protected], or by call or text to (833) 247-TECH.

Where you have agreed to receive text messages, we send them from that same number. You can stop them at any time by replying STOP, or reply HELP for assistance. The full terms of our messaging program are set out in our Privacy Policy.

We respond as promptly as we are able. We do not publish fixed business hours and we do not guarantee a response time.

Service area

We serve Pemberton Township and the surrounding communities, including Pemberton Borough, Browns Mills, Country Lakes, Presidential Lakes and Leisuretown.

Pricing is uniform across the entire service area. No distance surcharge applies.

How work is agreed

No work is carried out and no charge is incurred until the price has been presented to you and agreed.

You describe the problem. Where the work requires diagnosis first, we diagnose it and then provide a price for the repair. You decide whether to proceed.

A diagnosis that you decide not to act upon is not a failed repair. It is a completed diagnosis.

Prices

Prices are published on each service page. Where a price is stated as “starting at”, it represents a minimum rather than a fixed figure. Where a price is stated as flat, that is the price.

Published prices are subject to change. The price applicable to your work is the price quoted to you and agreed before work begins.

Securing an appointment

Every appointment is secured with a payment card. You enter your card details on a page operated by Stripe, our payment processor. We never see or hold your card number.

An authorization hold is then placed on that card. A hold is not a charge. It reserves an amount and takes nothing. You may see it listed as pending on your statement. Holds are placed before we travel to you, or before a remote session begins — in some cases shortly after an appointment is agreed, and in others nearer the date.

The amount held, and what becomes of it, depends on the service:

  • Work on equipment we collect — computer repair, virus and malware removal, new computer setup, operating system installation, and data transfer and backup. $19.99 is held, being the pickup and delivery fee. That single fee covers both the collection and the return, however many items are collected for the one job. Where the work proceeds, the hold is released and the pickup and delivery fee is payable together with the price of the service, on the day the equipment is returned to you.
  • Work carried out at your property — printer setup, home network configuration, security cameras, smart home setup, television wall mounting and home theater setup. $19.99 is held, being the call-out fee. Where the work proceeds, the hold is released and the call-out fee is absorbed into the price of the service; you pay only the service price, on the day.
  • Equipment you deliver to us. Where you deliver the equipment and collect it yourself, no pickup and delivery fee applies and no hold is placed. Payment for the work is due before the equipment is returned to you.
  • Remote assistance. $49.99 is held, being the first hour. Where the session goes ahead and the problem is resolved, that hold is captured and is the payment for the first hour. There is no travel fee of any kind, because no travel is involved.
  • Tech help and tutoring, remote. $49.99 is held, being the first hour, and captured at the end of the session.
  • Tech help and tutoring, on-site. $79.99 is held, being the on-site first hour, and captured at the end of the session. There is no separate call-out fee; travel is already included within that first hour.
  • Data recovery. Where we collect the equipment, $59.98 is held, being the $39.99 assessment fee together with the $19.99 pickup and delivery fee. The hold is released and both are payable on the day the equipment is returned to you. Where you deliver the equipment yourself, no hold is placed and the $39.99 assessment fee is payable before it is returned. The assessment fee is payable whatever the assessment establishes, including a finding that no data can be recovered.

The fee is $19.99 wherever you are within our service area, whether we collect your equipment or carry out the work at your property. There is no distance charge and no surcharge.

Payment

Where a hold is released, payment for the completed work is due on completion, on the day the work is carried out, and before any collected equipment is returned. Where we collected the equipment, the $19.99 pickup and delivery fee is payable at the same time, together with the price of the service.

Where a hold is captured, that capture is the payment for the period it covers. Where a remote session or tutoring session runs beyond the first hour, the additional time is charged at the applicable hourly rate and settled before the session ends.

We accept the following payment methods:

  • Credit card
  • Debit card
  • Cash
  • Apple Pay
  • Google Pay
  • Venmo
  • PayPal

Authorization holds can only be placed on a payment card. You may settle any remaining balance by any of the methods above.

How your card is stored

Your card is stored by Stripe, which processes payments on our behalf. Card details are entered on a page operated by Stripe and are held by Stripe. We do not see, receive or store your card number at any point.

By saving a card you authorize us to place authorization holds on it, and to capture those holds, in the circumstances set out in these terms and for no other purpose. We will not charge a stored card for anything other than work you have asked us to carry out and the cancellation and no-show charges described below.

You may ask us to remove a stored card at any time by emailing [email protected].

Where a hold cannot be placed — for example where a card has expired, has insufficient available credit, or is declined — we will contact you before the appointment so that it can be resolved.

Appointments, rescheduling and cancellations

Appointments may be rescheduled. We ask for at least 24 hours’ notice.

Where at least 24 hours’ notice is given, any hold is released in full and nothing is charged. This applies to every service.

A missed appointment costs $19.99, whatever service was booked. That is the same figure as our pickup and delivery fee and our call-out fee. It applies where less than 24 hours’ notice is given, where nobody is present at the property when we arrive to collect equipment or to carry out work, or where you do not join a remote session at the agreed time.

Where the amount held is greater than $19.99, only $19.99 is taken and the remainder is released.

Where we have already collected your equipment and you then cancel the work, the $19.99 pickup and delivery fee remains payable, the equipment is returned to you, and nothing further is charged.

Where we have to cancel or reschedule an appointment, any hold is released and nothing is charged.

Our guarantee

All completed work carries a 90-day guarantee on the service performed.

The remedy under this guarantee is the correction of the work, not a refund. Where work we performed is incomplete or was not carried out correctly, we return and put it right at no further charge — remotely where that is possible, in person where it is not. There is no limit on the number of return visits or sessions within the 90-day period; we continue until the work is complete.

No fix, no fee applies at the time of service: where we are unable to complete a repair, you do not pay for it, and any hold placed for that work is released. This determination is made before we leave the premises, or before a remote session ends.

The guarantee covers our labor. It does not extend to:

  • Parts supplied, which are covered solely by the manufacturer’s warranty.
  • Licenses and third-party services.
  • Data recovery, which is excluded for the reasons set out below.
  • New or unrelated problems, which are treated as new work.

Data recovery is excluded from the guarantee

Data recovery is the one service for which an outcome cannot be promised in advance, and it is excluded from the no fix, no fee guarantee.

It is priced on an assessment-first basis: a fee for a full diagnostic of the drive and the condition of the data upon it, followed by a separate quotation for the recovery itself. Where we collect the equipment, the assessment fee is held together with the pickup and delivery fee and both are payable when the equipment is returned to you. Where you deliver the equipment yourself, the assessment fee alone is payable and no pickup and delivery fee applies. The assessment fee covers the diagnostic whatever it establishes, including where the finding is that no data can be recovered.

Recovery work itself, where you choose to proceed with it, is quoted separately and is not covered by the assessment fee.

The reasoning is set out in full on the data recovery page.

Parts, licenses and hardware

Parts, licenses and third-party services are priced separately where applicable.

For television wall mounting, wall mount hardware is not included. We can supply a bracket at additional cost, or install one supplied by the customer.

Limits of liability

Pemberton Tech performs all services — including computer repair, virus and malware removal, data recovery, computer and device setup, operating system installation and upgrades, printer setup and troubleshooting, data transfer and backup, home network configuration, security camera installation, smart home setup, television wall mounting, home theater setup, remote assistance, and technology tutoring — with reasonable care and skill. Technology services nevertheless involve risks that may fall outside our control.

To the fullest extent permitted by law:

  • Customers are responsible for backing up all data before service. We are not responsible for lost, corrupted, inaccessible or unrecoverable data, files, programs, passwords or settings.
  • We are not responsible for problems caused by pre-existing damage, defective or failing equipment, incompatible hardware or software, inaccurate information provided to us, customer-supplied products, manufacturer defects, viruses or malware, power issues, unstable internet service, or operating-system updates.
  • For television mounting and physical installation, customers are responsible for identifying concealed wiring, plumbing, structural limitations, and any landlord or building restrictions. We are not responsible for damage arising from concealed conditions, or from unsuitable walls, surfaces, brackets or customer-supplied hardware.
  • For network and internet work, we are not responsible for the performance of your internet service provider, for service outages, or for the connection speed delivered to the property.
  • For remote assistance and remote tutoring, we are not responsible for the availability or performance of your internet connection, or of third-party remote-access software.
  • For security cameras and smart home equipment, we are not responsible for the continued availability, functionality or pricing of third-party applications, cloud services or subscriptions, which remain under the control of their providers.
  • For data recovery, outcomes cannot be guaranteed. Where data proves physically or logically unrecoverable, the assessment fee remains payable.
  • We are not responsible for indirect, incidental, special, consequential or lost-profit damages arising from our services.
  • Our total liability for any claim relating to a service will not exceed the amount paid for that specific service.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, intentional misconduct, or any other matter prohibited by applicable law.

Unpaid repairs and unclaimed equipment

Payment is due on completion of the work and before any collected equipment is returned.

Where equipment remains unpaid for 90 days following written notice that it is ready for collection, Pemberton Tech may commence the process permitted under New Jersey law to enforce its repairer’s lien, and arrange for the equipment to be sold or otherwise disposed of.

Any sale or disposal will take place only after the required notices and legal procedures have been completed. Prior to any lawful sale or disposal, reasonable steps will be taken to remove or securely erase personal data, so far as is practicable. Any proceeds will be handled as required by law.

Governing law

These Terms of Service are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute arising from these terms or from our services will be handled in the state or federal courts located in the New Jersey county in which Pemberton Tech is located, unless applicable law requires otherwise.

Nothing in these terms limits any right or remedy available to customers under applicable New Jersey or federal law.

Changes to these terms

Where these terms change, the updated version will be published on this page bearing a revised date below.
